Terms and Conditions of Use for the Online Portal Apartmaji Moravske Toplice (www.vital-resort.si)

The terms and conditions of use for the online portal Apartmaji Moravske Toplice (www.vital-resort.si) (hereinafter referred to as "terms and conditions") are prepared in accordance with the applicable regulations of the Republic of Slovenia and apply to all users and/or customers of the aforementioned portal and renters of apartments. These terms and conditions define the conditions of use of the online portal Apartmaji Moravske Toplice (www.vital-resort.si), the general conditions for online purchases, the general conditions for renting an apartment or room (hereinafter referred to as "apartment"), the protection of personal data, and other rights and obligations of the user/customer/renter and the provider.

Management of the Portal

The online portal Apartmaji Moravske Toplice (www.vital-resort.si) (hereinafter referred to as the "portal") is managed by the company JD Turizem d.o.o., Delavska ulica 21, 9226 Moravske Toplice, tax number: 30857643 (VAT liable), registration number: 8222401, registered at the District Court in Murska Sobota under the registration number Srg 2018/22752 (hereinafter referred to as the "provider").

Definitions of Users

  • User is any person who uses the portal and to whom these terms and conditions apply.
  • Renter is any person who has made a valid reservation, rental, or payment for the rental of an apartment, and to whom these terms and conditions apply.
  • Customer is any person who has made a purchase of services (not necessarily the rental of an apartment), and to whom these terms and conditions apply.

Acceptance of Terms

By using the portal, the user/renter/customer (hereinafter referred to as the "user") accepts these terms and conditions and confirms that they are aware of them and agree with them. The user is bound by the terms and conditions that are valid at the time of placing the online order. By placing an order, they agree that they are aware of them. The user has access to the terms and conditions on the portal, where they can download them to a permanent data carrier. If the renter/customer submits an inquiry by phone or via email and the provider makes an online purchase on their behalf, it is considered that they have been informed of the terms and conditions.

 

Operation and use of the portal and online purchase

Service Offerings

The services offered through the portal are part of the offerings of JD Turizem d.o.o. Product prices are presented as retail prices and include VAT.

Information Availability The provider commits to always ensuring the user receives the following information:

  • Company details (name, headquarters, tax, registration number, and registration details)
  • Contact details
  • Essential characteristics of the services and apartments for rent
  • Service price, including all taxes and other charges
  • Possible delivery costs
  • Detailed payment arrangements, method, and delivery or fulfillment period
  • Information on the consumer's right to withdraw from the contract according to Article 43.c of the Consumer Protection Act and the conditions for withdrawal, including any costs associated with withdrawal
  • Offer and price validity period
  • Explanation of the complaint procedure, including all contact information for the person responsible

Order and Purchase Procedure

Users can inquire or reserve an apartment rental and purchase additional services through the portal, by phone (+386 40 697 775), or by email at booking@vital-resort.si. Upon booking, a contract is concluded between the lessor and the lessee, which also serves as a reservation confirmation and includes details about the apartment type and rental dates.

Both individuals and legal entities can make purchases on the portal. Users select the desired service(s) and are redirected to the website www.fidelityhotel.net, managed by Mais Informacijski sistemi d.d. There, the user selects the apartment, enters the number of guests, reviews the service price, and confirms the selection by clicking "Reserve". After entering the number of guests and confirming this step, the user enters personal and credit card details. Upon accepting the terms and confirming the reservation, a confirmation screen appears with reservation details, including service selection, price, contact details, key pickup procedure, reception address, and important notices, followed by "Your reservation has been successfully completed."

Users receive a reservation notice via email. The general terms are available on the provider's website. If the user inquires by phone or email and the provider completes the online purchase on their behalf, it is assumed that the user is familiar with the general terms.

Payment Methods The provider offers the following payment methods:

  • Bank transfer to the provider’s account
  • Credit card
  • PayPal
  • Debit card (only at reception)
  • Cash (only at reception)
  • RS vouchers*
  • Gift vouchers**

The payment date is considered the day the provider receives the payment in the transaction account, PayPal account, or when the credit/debit card payment is processed or cash is received. A payment receipt can be issued upon request (for prepayments). The provider issues an invoice for the service during checkout or after the service is rendered.

*RS vouchers - vouchers provided under the regulation for improving the economic position in tourism, reimbursement through the Financial Administration of the Republic of Slovenia, and voucher management.

Gift vouchers from external providers (Hiša daril, SelectBox, etc.).

Prices Prices are expressed in €/night/apartment.

Therapies within packages must be completed within 18 months from the date of purchase.

Mandatory tourist tax payable upon departure (2.50 €/adult/night and 1.25 €/children 7-18 years/night).

Pet surcharge: 25.00 €/reservation.

In the case of promotional offers, prices are as specified in the individual promotional offer.

All prices include 9.5% VAT unless explicitly stated otherwise. Prices for wellness services and salt cave include 22% VAT.

Prices are valid at the time of order submission and do not have a predefined validity.

Prices are valid for payment methods and conditions listed in these general terms. Despite efforts to provide the most current and accurate information, price errors may occur. If the service price changes during order processing, the provider will allow the buyer to withdraw from the purchase.

Stays

Unless otherwise stated in the contract, the apartment rental price includes accommodation for up to:

  • 2 persons (Room 1 and Room 2)
  • 4 persons (Marjetica 6, Marjetica 24, Marjetica 31, Marjetica 39, Studio 3, Studio 5, Apartment 4, Apartment 6, and Apartment 7)
  • 5 persons (Vijolica 7, Tulpika 7, Tulpika 9, and Tulpika 16) or
  • 6 persons (Sončnica 4, Tulpika 4, Tulpika 14, Sončnica 16, Apartment 8, and Apartment 9).

The rental price of the apartment includes the use of equipment in the apartment, consumption of water and electricity, as well as the use of bed linen (for a baby cot, bed linen must be brought by the guest) and towels, and final cleaning. The tourist tax is not included in the rental price and must be paid upon check-in, or at the latest upon check-out at the reception.

Payment of Gift Vouchers, Bonuses, and Advance Invoices

Funds paid through gift vouchers, bonuses, and advance invoices do not earn interest. Gift vouchers and discount codes cannot be exchanged for cash.

Conclusion of the Purchase Agreement

The purchase agreement between the provider and the user is concluded at the moment when the provider confirms the order (the user receives an email about the placed order). From this moment, all prices and other conditions are fixed and apply to both the provider and the user. The registration fee and reservation costs paid by the tenant upon registration amount to at least 50% of the apartment rental price. The remaining amount must be paid by the tenant at least 14 days before the rental starts. If the remaining amount is not paid within the specified period, it is considered that the arrangement has been canceled, and the provisions on the tenant's cancellation of the rental in these general terms and conditions apply accordingly.

If the service price is not paid on time and no extension of the payment deadline has been agreed upon with the provider, it is considered that the contract has never been concluded. If the provider receives the payment late, after the payment deadline has expired, the user will be informed about the possibilities of service execution (possible service execution or cancellation, and in the case of cancellation, also the refund of the payment).

Wellness

Unless otherwise specified in the contract, the wellness price includes:

  • XL: XL hot tub (with water changed after each use), infrared and Finnish sauna, mini kitchen, relaxation area with heated water bed, private sanitary facilities and shower, TV and music, hairdryer, towel, sheet, small sparkling wine, dried fruit with nuts, tea and water.
  • L: Hot tub (with water changed after each use), Finnish sauna, mini kitchen, relaxation area with heated water bed, private sanitary facilities and shower, TV and music, hairdryer, towel, sheet, small sparkling wine, dried fruit with nuts, tea and water.
  • Children up to 15 years old enter for free.
  • Maximum number of people: 6

Key/Card Pickup and Ordering Additional Services

For apartment rental, the tenant will pick up the apartment key/card at the reception of Aparthotel Vital on the day of arrival, after 4 PM.

To use breakfast, half-board, or full-board, and to purchase lunch vouchers, the tenant must notify at least 3 days before arrival. The service is provided at Hotel Termal (half-board and full-board) or at the restaurant of the Terme 3000 swimming complex (daily lunch).

Swimming cards are picked up at the reception of Aparthotel Vital or can be purchased daily at the mentioned location.

Gift Voucher

The provider issues a gift voucher upon user payment, in paper and/or electronic form (the user receives the voucher and/or an email with the gift voucher code). Each gift voucher is marked with its code and the provider is obliged to accept it as payment for the purchase of services through the portal.

A gift voucher can be ordered online, by calling 040 697 775, or by sending an email to booking@vital-resort.si. The same terms and conditions apply to the purchase of a gift voucher as to the purchase of other items. The validity of the gift voucher is 12 months from the date of issue unless otherwise indicated on the voucher.

Gift vouchers cannot be exchanged for cash. The voucher can only be redeemed for the full amount. It can be redeemed only for apartment rental, unless otherwise agreed. If the purchase value is higher than the gift voucher value, the voucher holder must pay the difference. The purchase value must be equal to or higher than the gift voucher value.

 

 

Right to withdraw from rent/purchase and handling complaints and complaints

 

Right to Cancel the Rental - Tenant

The tenant has the right to cancel the apartment rental. In this case, the provider has the right to reimbursement of costs due to the cancellation of the rental. The amount of reimbursement for cancellation costs depends on the time in which the tenant submitted the cancellation or otherwise canceled the rental. If the tenant has paid for additional services (swimming passes and meals), the amount paid for these additional services will be refunded in full.

The tenant must notify the provider in writing of the cancellation of the apartment rental (by mail to the address JD Turizem d.o.o., Delavska ulica 21, 9226 Moravske Toplice, or by email to booking@vital-resort.si). If the cancellation is not in writing, it is considered as if the rental has not been canceled. If the tenant terminates their stay in the apartment for reasons not dependent on the provider (e.g., tenant's illness), they are not entitled to a refund of costs or the rental fee, neither in part nor in full.

In the case of cancellation of the rental during the rental period due to force majeure, without any fault on the part of the provider due to improperly performed service, the tenant has no right to claim any compensation or price reduction.

The tenant can change the name and/or number of people who will stay in the apartment after the contract has been concluded, provided that the change is agreed upon with the provider.

When the provider receives a cancellation notice from the tenant, it is:

  • Free of charge if the written cancellation is received at least 14 days before arrival,
  • Charged at 100% of the apartment/room rental price if the tenant submits it after the free cancellation period,
  • For individuals who book through booking.com, the conditions specified upon reservation confirmation on booking.com apply.

Right to Cancel the Rental - Provider

JD Turizem d.o.o. reserves the right to cancel the rental in accordance with applicable legislation if extraordinary circumstances arise before or during the rental period that could not have been anticipated, removed, or avoided, and for JD Turizem d.o.o. these circumstances constitute a justified reason not to enter into the contract if they had existed at the time of the contract conclusion. JD Turizem d.o.o. may cancel the contract and claim damages from the tenant who directly violates the provisions of the contract concluded with JD Turizem d.o.o., especially if it is found that the tenant deliberately provided false information about the number of tenants, or if such changes occur during the rental period, and the tenant did not inform JD Turizem d.o.o. In the event that JD Turizem d.o.o. cancels the rental for objective reasons, the tenant has the right to a full refund of the rental price paid. In the event of breaches of contract provisions by the tenant, the tenant is not entitled to a refund of the rental price paid. The provider reserves the right to claim damages caused by the tenant in the apartment, if the damage exceeds €25.

Right to Cancel Additional Services - Tenant and/or Buyer

The user can cancel the purchase of services (swimming passes and meals):

  • No later than 1 day before arrival at the apartment (if they rented the apartment), or
  • In the case of an independent purchase of services (without renting an apartment), no later than 14 days from the date of purchase. The purchase date is considered the date when the swimming passes or meal vouchers were delivered.

The buyer communicates the cancellation of the contract to the seller's email address: booking@vital-resort.si. In the event of contract cancellation, the buyer returns the received item by mail to the seller's address: JD Turizem d.o.o., Delavska ulica 21, 9226 Moravske Toplice. Returning the received items to the company within the contract cancellation period is considered a notification of contract cancellation. The buyer must return the item to the seller undamaged and in the same quantity. The buyer is responsible for any reduction in the value of the goods (damage/destruction of swimming passes and/or meal vouchers) if the reduction is due to the buyer's actions. The only cost that burdens the consumer in connection with timely cancellation of the contract is the cost of returning the items (which is charged according to the delivery service price list). The item must be returned to the seller no later than 30 days from the notification of contract cancellation (purchase). The refund of payments will be made as soon as possible, but no later than within 14 days:

  • From the receipt of the contract cancellation notice (in the case of apartment rental cancellation), or
  • When the provider receives the returned goods (swimming passes and/or meal vouchers).

If the cancellation of the service purchase is timely, the buyer will be refunded the full amount paid. If the cancellation of the purchase is not timely, the provider retains 30% of the amount paid.

Complaints and Appeals

In the event of irregularities or deficiencies in the apartment rental, the tenant should report them directly to the provider's contact person (indicated on the invoice, voucher for key collection, and in the documentation located in the apartment) or in writing (by mail to the address JD Turizem d.o.o., Delavska ulica 21, 9226 Moravske Toplice, or by email to booking@vital-resort.si). If the complaint could be resolved on the spot (e.g., room cleanliness deficiency), and the tenant did not address the issue on the spot and did not notify the provider of the irregularity, it is considered that the tenant accepted the service as is and thereby lost the right to file later complaints demanding a reduction in the rental price or compensation. The tenant can file a complaint in writing no later than 3 days after leaving the apartment. The complaint must be signed and can be filed by the tenant themselves or by authorizing a third party in writing. The authorization must be attached to the complaint; otherwise, the provider will not consider the complaint. The complaint must be substantiated. Therefore, the tenant should attach appropriate evidence and/or a suitable receipt from the reception or another appropriate person regarding the actual situation on which they base their claim. The amount of compensation is in any case limited to the amount paid for the arrangement. Without a written complaint, the provider does not consider claims for price reductions and other compensation claims.

Refunds

To ensure certainty, accuracy, and timeliness of refunds and to maintain a record of payments, refunds to the buyer are made exclusively by transfer to their bank account/PayPal account (the buyer must confirm the bank account number and other necessary details for the transfer in advance). Cash refunds are not possible. In the event of contract cancellation, a gift voucher is considered a means of payment and is returned to the user as a gift voucher, while the paid amount is refunded to the user's bank account. The amount for the refund, which is in accordance with the general terms and conditions, is returned to the user's bank account. Returning the received goods to the company within the contract cancellation period is considered a notification of contract cancellation.

 

Apartment rental (house rules)

General Terms of Apartment Rental

These terms apply to the rental of apartments Sunflower 4, Sunflower 16, Tulip 4, Tulip 14, Tulip 7, Tulip 9, Tulip 16, Violet 7, Daisy 6, Daisy 24, Daisy 31, and Daisy 39 in the tourist settlement Prekmurska vas in Moravske Toplice (Terme 3000) and for Room 1, Room 2, Studio 3, Studio 5, Apartment 4, Apartment 6, Apartment 7, Apartment 8, and Apartment 9 in Aparthotel Vital. The aforementioned living units are owned by the company JD Investments, LLC, managed by JD Turizem, LLC. General terms for renting and using an apartment apply together with the house rules of Term 3000 (the house rules are located in the apartment). The tenant is familiar with them and accepts them when submitting a reservation or application for the use of the apartment in oral, written, or electronic form. The general terms can be found on the website and in the apartment.

The tenant must provide the required information upon registration and guarantee its accuracy. In case the tenant does not provide correct information upon registration, he/she is responsible for all costs or consequences arising from incorrect information. The tenant's registration is binding. It can only be canceled in accordance with the provisions regarding the tenant's termination of the lease.

Cancellation of Apartment Rental Cancellation of apartment rental by the tenant and the provider is defined in the chapter Right of withdrawal from the purchase.

Information The information provided to the tenant at the registration site does not bind the provider more than the provisions in these general terms or the contract. In case of doubt, a written offer, written information, or written explanation is always considered valid.

Although the provider strives to provide accurate photographs of the apartments and other services, all photographs should be considered symbolic.

Arrival and Departure of the Tenant Check-in is possible after 4:00 PM on the day of arrival. If the apartment is available and ready for occupancy before 4:00 PM, check-in is also possible before 4:00 PM. On the day of departure, the apartment must be vacated by 10:00 AM, unless otherwise specified in the contract.

Key/card collection, reception of Aparthotel Vital Upon check-in at the reception, a personal identification card, passport, or driver's license must be presented for all persons.

Reception - Aparthotel Vital, Delavska ulica 21, 9226 Moravske Toplice:

Key collection: after 4:00 PM on the day of arrival (until 8:00 PM)* Return of keys/cards and payment of tourist tax: on the day of departure by 10:00 AM.

*If you arrive after 8:00 PM, please inform us so that we can send you instructions for self-collection of keys/cards.

Misuse and resale of keys/cards are punishable. A fee of €20.00 is charged for each lost or stolen key/card, and the invoice is issued by JD Turizem, LLC.

Other instructions Smoking in the apartment is strictly prohibited.

Pets are allowed in apartment Tulip 14, or otherwise, if expressly permitted by the provider. The provider is not responsible for allergies and similar illnesses resulting from the presence of animals in the apartment. Registration of pets is mandatory when booking the apartment.

The tenant uses all devices in the apartment in accordance with the instructions for safe use and takes care of the equipment as a good steward. If damage is caused, intentionally or through negligence, the tenant is obliged to reimburse it. In case of damage to the apartment, the tenant must immediately inform the owner.

Guests upon departure from the apartment:

tidy up the apartment (cupboards, cabinets, refrigerator, bathroom...) clean the dishes they used, take out the trash, turn off appliances (e.g., air conditioning in summer, set heating to 10°C in winter...) and close shutters and doors.

The tenant may not sublet the apartment or allow it to be used by any other person.

Reporting faults in electrical and plumbing fixtures The tenant is obliged to immediately report any faults that could result in damage to the property of JD Investments, LLC, due to malfunctioning electrical and plumbing fixtures. The fault is rectified by a professionally trained person designated by JD Turizem, LLC. The tenant is expressly prohibited from any intervention on the mentioned fixtures without authorization. JD Turizem, LLC is not responsible for the health and life of the tenant or other persons in case of unauthorized intervention by the tenant or other persons.

Complaints Complaints from the tenant are defined in the chapter Right of withdrawal from the lease and/or purchase and handling of complaints.

Loss of property, fire, or theft The lessor is not responsible for the tenant's personal property or the property of another person left in the rented apartment. By entering into the contract (confirmed reservation), the tenant expressly waives any claim arising from this article and related costs.

In case of an accident, the tenant must first take care of all participants and provide first aid if necessary.

In case of theft, the tenant must immediately notify the lessor and call the police (113) to make a police report, which is ESSENTIAL to do in such a case.

In case of a minor fire, the tenant must first try to extinguish the fire. In case of a major fire, the tenant must immediately call the fire brigade (112), which is ESSENTIAL to do in such a case.

The lessor's liability The lessor ensures that the apartment and all devices in the apartment are technically flawless, without defects that could cause complications or accidents.

In case of a damaged apartment, after prior agreement with the tenant, the lessor arranges for another rental term.

The lessor is not responsible for personal property left in the apartment.

The lessor is not liable in other cases.

Rental of Wellness Room and/or Salt Room (House Rules)

General terms of renting a wellness room/salt room apply to the rental of units owned by JD Investments, LLC, managed by JD Turizem, LLC. The tenant is familiar with the rules and accepts them when arranging a reservation in oral, written, or electronic form. The general terms can be found on the website and in Aparthotel Vital.

Information The information provided to the tenant at the registration site does not bind the provider more than the provisions in these general terms or the contract. In case of doubt, a written offer, written information, or written explanation is always considered valid.

Although the provider strives to provide accurate photographs of the wellness and salt rooms, all photographs should be considered symbolic.

Arrival and Departure of the Tenant Terms must be reserved in advance. Renting the wellness room is arranged for a specific time and duration, salt therapies are performed for 50 minutes for adults and 25 minutes for children. The first available booking slot is from 9:00 AM, and the last booking slot is at 8:00 PM.

Guest reception is at the reception of Aparthotel Vital, Delavska ulica 21, 9226 Moravske Toplice. The guest agrees to vacate the wellness room/salt room at the agreed time of reservation.

Other instructions:
The tenant shall use all devices in the wellness room/salt room following the instructions for safe use and shall take care of the equipment as a good steward. If they cause damage, whether intentionally or through negligence, they are obligated to reimburse it. In case of any damage in the room, the tenant must immediately inform the owner.

Smoking in the wellness room/salt room is strictly prohibited.
Sauna visitors must adhere to the instructions or recommendations posted in the premises.
We do not take responsibility for valuables and wardrobe.
Walk slowly and carefully in the premises, as the floors may be wet and slippery.
Smoking and bringing in food and drinks are not allowed.
Non-swimmers are not allowed to step in.
All information regarding salt therapies is for informational purposes only and in no way intended to replace advice from your physician or healthcare professional; they are also not a substitute for proper medical care, as they are not recognized by health authorities. If you are taking any medications and/or other dietary supplements, consult your physician before combining them with our services.
Free parking is available in front of Aparthotel Vital.

Loss of property, fire:
The landlord is not liable for the tenant's personal property or the property of another person left in the wellness room/salt room. By entering into the contract (confirmed reservation), the tenant expressly waives any claim arising from this article and related costs.

In case of an accident, the tenant must first attend to all participants and provide necessary first aid.

In case of a minor fire, the tenant must first attempt to extinguish it. If it is a major fire, they must immediately call the fire department (112), which is ESSENTIAL to do in such a case.

Protection of personal data and security

 

Protection of personal data:
The provider may use and process all obtained personal data in accordance with the provisions of the Personal Data Protection Act and for the purposes specified below. The provider temporarily stores the IP addresses of all portal visitors to prevent potential abuses (up to a maximum of 30 days). The provider will use personal data exclusively for the purpose of fulfilling the order (transaction execution, invoice issuance, delivery of bathing cards and vouchers, preparation of vouchers, all related to the order) and other necessary communication related to the order. User registration is not required to place an order. We do not take responsibility for the accuracy of the data entered by the user when placing an order.

Under no circumstances will the user's data be disclosed to unauthorized persons. Exceptional disclosure of personal data occurs only if such obligation is determined by law or in good faith that such action is necessary for court proceedings or other government authorities and for the protection and realization of the legitimate interests of the company JD Turizem d.o.o.

The user is also responsible for protecting personal data by ensuring appropriate software (antivirus) protection of their computer.

The user may at any time, in writing or by other agreed means (e.g., via email), request the data controller to permanently or temporarily cease using their personal data for direct marketing purposes. The data controller will prevent the use of personal data for direct marketing purposes within 15 (fifteen) days and inform the user who made the request in writing or by other agreed means (e.g., via email) within the following 5 (five) days.

Contract and archiving of the contract:
The contract is concluded when the provider confirms receipt of the order, namely by sending an electronic message to the provided email address. The contract is concluded in the Slovenian language. The concluded contract between the user and the seller, as well as copies of invoices, are archived in electronic and/or printed form by the provider.

User opinions/comments:
Opinions or comments written by users are part of the portal intended for the user community. The provider allows any portal user to write an opinion, but the provider reviews them before final publication. The provider will not publish opinions or contributions that are in any way offensive, obscene, or, in the opinion of the provider, do not provide benefits to other users and visitors. The provider does not take responsibility for the information in opinions and disclaims any liability arising from information in opinions.

By submitting an opinion or comment, the user expressly agrees to the general terms and allows the provider to publish part or all of the text in all electronic and other media. The provider has the right to use the content indefinitely and for any purpose that is in the business interest of the provider, including publication in advertisements or other marketing communications. The author of the opinion also declares and guarantees that they are the owner of the material and moral copyright for the written opinions and comments and that these rights are transferred non-exclusively and indefinitely to the provider.

Security:
The providers JD Turizem d.o.o. and Mais Informacijski sistemi d.d. use appropriate technological and organizational means to protect the transmission and storage of personal data and credit card data. Mais Informacijski sistemi d.d. uses a 128-bit SSL certificate issued by an authorized organization for the reservation process. Credit card data is stored on payment service servers and deleted in accordance with PCI SSC standards. JD Turizem d.o.o. does not process or store credit card data. Credit card charges are not made directly online but are manually processed at the reception of Aparthotel Vital, in accordance with the terms specified during the apartment rental reservation.

 

Final provisions

The provider reserves the right to change the general terms and conditions of business at any time and in any manner, regardless of the reason and without prior notice.

The provider will inform users of any changes to the general terms and conditions of business in an appropriate manner. Posting the general terms and conditions of business on the website www.vital-resort.si is considered an appropriate manner. It is considered that the user agrees to the change in the general terms and conditions of business if they continue to use the respective portal.

Objections, comments, claims, statements, and complaints can be sent by the user via email to booking@vital-resort.si or in writing to the address: JD Turizem d.o.o., Delavska ulica 21, 9226 Moravske Toplice. The resolution of objections, comments, claims, and complaints will be conducted in accordance with the provisions of the applicable legislation.

For all disputes arising from the use of the website portal and these general terms and conditions of business that the provider and the user could not resolve amicably, the competent court shall be the substantive competent court according to the provider's registered office. The tenant's plea of not being aware of the contract's contents does not delay the proceedings before the court.

These general terms and conditions apply to all contracts concluded from the date of publication of the Rental Terms.

DEFINITION OF TERMS

The organizer of the sweepstakes on the Facebook page WELLNESS VITAL is JD TURIZEM, d.o.o., Delavska ulica 21, 226 Moravske Toplice. The sweepstakes are not sponsored, endorsed, administered by, or associated with Facebook. A participant in the sweepstakes is an individual who participates in the advertised promotional activities. The winner of the sweepstakes is determined by random draw.

RIGHT TO PARTICIPATE IN THE SWEEPSTAKES

Participants in the sweepstakes must be adults. Citizens of the Republic of Slovenia (individuals) can participate in the sweepstakes. Those under 18 years of age must obtain parental consent to participate. Legal entities cannot participate in the sweepstakes. Individuals who do not accept the rules of the sweepstakes cannot participate. It is considered that a participant has accepted the rules of the sweepstakes by participating in the advertised sweepstakes.

RULES OF PARTICIPATION IN THE SWEEPSTAKES

No purchase of services from the sweepstakes organizer is necessary to participate in the sweepstakes. All participants in the sweepstakes who like and share the post and comment on the Facebook post of the sweepstakes by tagging a person with whom they would enjoy the prize are eligible for the draw. Each participant can only participate once in the prize draw. The sweepstakes run until the date specified in the post until 23:59. The result of the draw is final and announced the next day. There is no possibility of appeal. The winner will be notified of the receipt and method of collecting the prize by email or via Facebook message.

WINNER'S OBLIGATIONS

Cash payment of the prize is not possible, nor is it possible to exchange it for another item. The winner must provide their personal information to the sweepstakes organizer in writing (by email): name, surname, address, email, telephone, and tax number, all no later than two days after receiving the notification that they have won the prize. The payment of all taxes on the prize (including VAT) is the responsibility of the organizer. The organizer will send certificates to the prize winners in accordance with the Income Tax Act and the regulation on the delivery of data for the assessment of income tax. The winner must declare the value of the prize in the income tax return. The organizer is not responsible for taxes that may arise in connection with any other prizes. If the winner does not fulfill all obligations, it is considered that the winner does not want to accept the prize, and the organizer is released from all obligations in relation to the winner in this sweepstakes and reserves the right to dispose of the prize for any other purpose. Prizes are not transferable. If the sweepstakes organizer does not receive all the necessary data and statements from the winner for any reason (e.g., the winner states that they do not want to accept the prize, the address or email address is incomplete or incorrect, etc.) within three (3) working days from the moment the organizer sends the notification that they have been drawn, it is considered that the winner does not want to accept the prize, and the organizer is released from all obligations in relation to the winner in this sweepstakes and reserves the right to dispose of the prize for any other purpose. The organizers and persons involved in the execution of the sweepstakes are not liable for any damages that may arise from the prizes. The organizer assumes no responsibility for any undesirable consequences that the participants and/or any third parties may suffer as a result of participating in the sweepstakes or using the prize.

PROTECTION OF PERSONAL DATA

The organizer will use personal data solely for the purpose of delivering the prize and possibly paying the advance income tax in accordance with applicable regulations. The organizer undertakes that the data provided by the prize winners will not be handed over to a third party or used in any other way contrary to the legislation of the Republic of Slovenia.

PUBLICATION OF SWEEPSTAKES RULES

By participating in the sweepstakes, participants agree that they are aware of the rules and undertake to comply with the rules of the sweepstakes. In the event of any dispute or ambiguity, these rules take precedence over any other publications, whether in printed, electronic, or any other form.

DURATION OF THE SWEEPSTAKES

The sweepstakes on Facebook run until the date specified on Facebook in the post.

PRIZE
